Training for a Retention Trust Account

Compulsory Training
If the head contractor will not be responsible for administering the Retention Trust Account, it must nominate a person who will be responsible for administering the Retention Trust Account on its behalf and give written notice of that person to the Queensland Building and Construction Commissioner using an approved way. The head contractor can change the nomination at any time and must make another nomination if the previous nominee is no longer responsible for administering the Retention Trust Account i.e. no longer part of their role, no longer working for the head contractor etc.
The head contractor must ensure that each person it nominates (or the head contractor if no person is nominated) undertakes the training prescribed by regulation within the period prescribed by regulation (max penalty: 100 PU ($14,375)). The QBCC is running the training – details can be found here.
A regulation may provide for:
- a fee for retention trust training;
- an extension of time for the head contractor to complete the training; or
- an exemption from the requirement for the head contractor to complete the training.

If the head contractor does not nominate a person to be responsible for administering the Retention Trust Account, then the head contractor must undertake the compulsory training itself.
The head contractor must pay all costs associated with the Retention Trust Account training.
This page considers the situation where Retention Trusts apply to subcontracts. Unless noted otherwise, all references to a ‘subcontractor’ in relation to a subcontract Retention Trust refers to a subcontractor that is a beneficiary of the associated Project Trust.
If a head contract requires a Retention Trust, the rules set out on this page are the same but the principal is the ‘trustee’ and all head contractors are ‘beneficiaries’ for head contracts that are Project Trust Contracts.
If a lower-tier subcontract also requires a Retention Trust, the rules set out on this page are the same but the higher tier subcontractor is the ‘trustee’ and its subcontractors are ‘subcontractor beneficiaries’.
